TMC MP moves HC seeking quashing of cyber crime FIR | Ahmedabad News | #cybercrime | #infosec | #hacking | #aihp


Trinamool Congress national spokesperson and Rajya Sabha MP Saket Gokhale moved Gujarat High Court on April 1, seeking quashing of an FIR lodged against him in December 2022 by the Ahmedabad cyber crime police station, which has formed the basis of Prevention of Money Laundering Act (PMLA) proceedings against him.

Mentioned before the court of Justice H D Suthar on Wednesday, the matter will be heard on April 12.

The latest legal recourse taken by Gokhale comes after Ahmedabad rural court on March 1 rejected his plea seeking that the case arising out of the December 2022 FIR be dropped.

Gokhale is facing charges under sections 406 (criminal breach of trust), 420 (cheating), 465, 468 (forgery) and 471 (using forged document) of Indian Penal Code as well as under sections 66C (punishment for identity theft) and 66D (cheat by personation) of IT Act. Following the FIR, Gokhale was arrested by the ED on January 25, 2023.

He is also facing a PMLA case for alleged misuse of money received via crowdfunding based on this FIR lodged by the cyber crime police station. The ED had investigated the money trail of nearly Rs 1.07 crore in Gokhale’s accounts, of which around Rs 76 lakh was received through online crowdfunding campaigns and Rs 23 lakh via cash transfers.

While opposing the discharge plea before the Ahmedabad rural court, the prosecution had alleged that Gokhale had obtained Rs 76 lakh in his bank accounts through crowdfunding platforms OurDemocracy.in and Razorpay and had used the same for personal purposes, thereby committing the alleged offence of cheating and breach of trust.

The court of Principal District Judge D M Vyas, while rejecting Gokhale’s discharge plea on March 1, had ruled that prima facie case is made out to frame charges against Gokhale.
